Changing School Category to Foundation
This is guidance issued by the Secretary of State under s21(6) of the Education and Inspections Act 2006. It is for governing bodies of community, VA or VC schools wishing to change category to foundation, the Schools Adjudicator and parents/stakeholders interested in such proposals. The Trust and Foundation Schools Partnership (TFSP) -a consortium of the Specialist Schools and Academies Trust (SSAT), Youth Sport Trust (YST) and the Foundation and Aided Schools National Association (FASNA)- provides help to primary, secondary and special schools who wish to explore Trust status further. Trust School Proposals
This is guidance issued by the Secretary of State under s21(6) of the EIA 2006. It is aimed at governing bodies of foundation schools that are considering the acquisition of a foundation (i.e. becoming a Trust School); the acquisition of an instrument of government providing for a majority of governors to be appointed by the school’s foundation; governing bodies of other categories of school that are seeking to make one or both of these changes together with a change of category to foundation. The guidance is also for the Schools Adjudicator;
local authorities, those seeking to work with a school as a Trust partner and parents or stakeholders with an interest in such proposals. Further guidance/support is available from the TFSP (see above). The Consortium can also help establish links with prospective Trust partners. There is also a Trust Schools Toolkit available (see below), but this should be read in conjunction with this guidance.

Trust Schools Toolkit
This toolkit has been created to support schools wishing to become a Trust school. It is for existing schools changing category and/or acquiring a Trust under the Prescribed Alterations regulations. It should be read in conjunction with the 'Trust School Proposals' guidance.
Anyone wishing to set up a new school as a Trust school (including a replacement school where the predecessor school is closed), should consult the relevant guidance (under the 'Establish a New School' button, on the left hand menu bar), depending on whether they are wishing to establish the school through a competition, or outside a competition, or are an independent school wishing to come into the maintained sector.

Removal of a School’s Trust and Reduction in the Number of Governors Appointed by The Trust
This is guidance issued by the Secretary of State under Regulation 19 of The School Organisation (Removal of Foundation, Reduction in Number of Foundation Governors and Ability of Foundation to Pay Debts) (England) Regulations 2007, SI 2007 No 3475, and general guidance about the statutory process. It is aimed at the governing bodies of those Trust Schools which may publish and determine proposals to remove the school’s Trust or, where the Trust appoints a majority of the governors, to remove the ability of the Trust to appoint a majority of governors on the governing body; and the Schools Adjudicator, who may have a role in determining any questions of compensation for land and assets that may arise when a Trust is removed.
