This guide has been updated to reflect changes introduced by the School Organisation and Governance (Amendment)(England) Regulations 2009, which came into force 1/9/09. Guidance Supplement - Opening a Special School
We have started to publish supplementary guidance which summarises the additional points to be taken into account when proposing to open, close or make changes to special schools. Those who are proposing or making decisions on special schools will be able to use the guidance relating to mainstream schools, using the supplementary guidance to identify any additional or different requirements.

Guide for people wishing to enter a new school competition
This guide is for people - proposers (other than local authorities) - who wish to submit proposals for a new school in response to a local authority competition notice. There is also a leaflet available (http://publications.teachernet.gov.uk/default.aspx?PageFunction=productdetails&PageMode=publications&ProductId=DCSF-00702-2009), which is intended to provide a summary and overview of competitions for those unfamiliar with the process.
It provides information on how to enter a competition, the process involved, how they are judged and the next steps if a school is successful.

Guide for people wishing to set up a new school outside a competition
This guide is for groups of people – proposers, other than a Local Authority – who wish to set up a new maintained school outside of a new school competition, to increase diversity and meet a particular local need. These are publicly funded schools maintained by the local authority and established under section 10 of the Education and Inspections Act 2006. NB. The APPLICATION FORM, to be used by proposers other than the LA to request 'exemption', is on page 26.
